OFFICIAL WAIVER & RELEASE OF LIABILITY & IDEMNIFICATION FORM (“RELEASE”)
THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY BEFORE DECIDING WHETHER TO SIGN.
I, the undersigned desire and voluntarily elect to participate as a member organized by Ethic Indoor, located at the Orthopaedic Associates of Wisconsin Indoor Facility. I understand that there are inherent risks and hazards involved in participating in activities including but not limited to those associated with weather conditions, playing conditions, equipment and other participants, in addition to the acts of pitching, throwing, fielding and catching of the ball, the swinging of the bat, running, jumping, stretching, sliding, diving and collisions with other players and with stationary objects, all of which can cause serious injury or death. I agree that in consideration for the right to participate in the Ethic Indoor and for permission to play on the field arranged for by the team:
1.) I voluntarily accept and assume all risks, including those outlined above, of damages or injury, including death, incurred or suffered by me (a) while practicing or playing as a participant in the Ethic Indoor, (b) while serving in a nonplaying capacity as a team member or observer during practice or play in the Ethic Indoor, and (c) while on or upon the premise of any and all of the fields arranged for by my team for practice or play, including but not limited to the Orthopaedic Associates of Wisconsin Indoor Facility.
2.) I waive, release, discharge and agree not to sue Ethic Indoor, LLC, Ethic Sports Academy or Orthopaedic Associates of Wisconsin Indoor Facility (together, the “Companies”), or their owners, officers, umpires, agents, servants, associations, employees, volunteers, or any person or entity acting on their behalf for any liabilities, claim, damages, cost or cause of action which I have or may in the future have as a result of injuries or damages arising from my participation in the Ethic Indoor caused by negligence or other acts or omissions of the released parties. This Release does not relieve any party from liability for reckless or intentional acts.
3.) I agree to defend, hold harmless and indemnify the parties hereby released from any claims, damages, costs (including attorney fees), and causes of action which may arise from any claim or cause of action made by me or on my behalf even if the damages, injuries or death are caused in whole or in part by any of the parties hereby released.
4.) I further understand and acknowledge that I have been and have hereby advised me to consult with my personal physician before undertaking participation in the Ethic Indoor.
• I have read the foregoing RELEASE, and hereby AGREE TO BE BOUND BY IT. By signing, I acknowledge and agree that I am giving up significant legal rights by signing it, that I am doing so freely and voluntarily, and that no other oral representations, statements or inducements have been made by the Companies with respect to the subject matter discussed above. I UNDERSTAND THAT I HAVE THE RIGHT TO REQUEST DIFFERENT TERMS, BUT BY SIGNING THIS RELEASE, I WAIVE THIS RIGHT AND AGREE TO THE TERMS CONTAINED HEREIN. IF SIGNING AS PARENT OR GUARDIAN, I ACCEPT THESE TERMS ON BEHALF OF THE MINOR PLAYER NAMED BELOW.
